European Commission consults on commitments offered by Disney in pay TV geo-blocking investigation

The European Commission is seeking comments on commitments put forward by The Walt Disney Company to address competition concerns about its contractual provisions, which the Commission alleges restrict cross-border provision of pay TV services in breach of Article 101 TFEU.

The Commission raised concerns that Disney’s licensing agreements with Sky UK contained a provision that limits or prevents Sky from making available its pay TV services in response to unsolicited requests from consumers in the EEA but outside the United Kingdom and Republic of Ireland.

Disney has offered proposals to remove clauses in its contracts with pay TV providers such as Sky that require them to block access to Disney’s films based on a consumer’s location. Disney's proposals are similar to the Paramount commitments accepted by the Commission in 2016.  Meanwhile, the Commission is continuing an investigation into the conduct of NBCUniversal, Sony Pictures, Fox, Warner Bros and Sky UK.
