As I am sure you all remember, the Deregulation Act 2015 made significant changes to Assured Shorthold Tenancies so that for tenancies granted on or after 1/10/15, a s.21 notice cannot be served unless the tenant has been provided with
- the Energy Performance Certificate for the property,
- a current gas safety certificate, and
- the up to date version of the booklet “How to rent: the checklist for renting in England” published by the Department for Communities and Local Government.
A prescribed s.21 notice was also introduced for these tenancies along with provisions preventing the service of a s.21 within 6 months of a relevant notice (improvement or emergency remedial action notices under the Housing Act 2004).
Now the Accelerated Possession Form N5B has been updated to reflect the s.21 requirements, with boxes to tick to show that the formalities have been complied with, and to confirm that it is not a retaliatory eviction. A copy of the form is available here .
