Summary of Practice

Timothy Lyons, QC, is a specialist in UK and EU tax law. He practises in both direct and indirect tax, representing taxpayers and occasionally advising governments, on matters that have ranged from estate planning and the taxation of trusts, to VAT, anti-dumping duty and WTO law.

Clients include governments and administrations as well as taxpayers. He is a member of the European Commission's expert group established as part of the review of the Savings Directive and is well-known for his work in the field of EU law and taxation.

On the direct tax side he is instructed in a wide range of matters, particularly for private clients with international interests.

On the indirect tax side he deals with VAT and other duties, including customs duty and anti-dumping duty. Cases of note include: Man in Black concerned with cross-border excise duty and BUPA, one of the well-known ECJ VAT cases concerned with abuse of right. He is currently instructed, amongst other things, in an appeal concerning the validity of an EC regulation imposing anti-dumping duty.

Publications

 On the direct tax side, he is the general editor of Sweet & Maxwell's European Cross-Border Estate Planning assisted by an editorial board consisting of Richard Frimston (Russell-Cooke) Filippo Noseda (Withers) and Beatrice Puotti-ffiske (Burges-Salmon). He is joint editor of the IBFD's International Guide to the Taxation of Trusts.

On the indirect tax side, his book EC Customs Law (OUP; 2008, 2nd ed) is recognised as a leading publication in the field. He is a contributor to Value Added Tax: Commentary & Analysis (Sweet & Maxwell) August 2009.

He is also Assistant Editor-European Law of the British Tax Review.
