Zenith’s Guy Swiffen and Lucy Sowden were recently in front of Mr Justice Cobb. Further guidance was given on cases concerning relinquished babies.

On 30th January 2019, Mr Justice Cobb gave further guidance on cases concerning relinquished babies. He advised that Local Authorities should consider whether relatives need to be assessed, or at least sufficient information gathered, to enable them to analyse whether the extended family should be contacted at the earliest opportunity.

In the event that there are some (good) reasons why the extended family should not be considered, the Local Authority should make a prompt application, under Part 19 FPR, for a declaration that the Local Authority does not need to contact the relatives nor conduct any assessments of them.
