ASPDEN v ELVY [2012] EWHC 1387 (Ch)
This case is one of the first following Jones v. Kernott [2011] UKSC 53 to consider the approach to establishing a beneficial interest in sole name cases. Sarah Greenan and Elizabeth Darlington, both of Zenith Chambers, were instructed for the Claimant and Defendant respectively. It was heard by HHJ Behrens sitting as a High Court Judge in April 2012 and judgment was handed down on 23rd May 2012.
