Gordon Exall, a senior junior member of our Personal Injury team writes in the June edition of the Apil PI Focus magazine on 'Keeping your witnesses out of jail.'
In the article he looks at the lessons learnt in the case of Motor Insurers Bureau v James Shikhell et al [2011] EWCH 527 QB, in which he represented a witness who was acquitted of contempt of court when proceedings were issued against Shikhell following allegations that his witness statements contained false information concerning the state of his health. He goes on to give 10 basic rules for avoiding problems in the drafting of witness statements.
